Terms & Conditions of Use

THIS PAGE CONTAINS INFORMATION ABOUT YOUR RIGHTS, OBLIGATIONS, LIMITATIONS AND EXCLUSIONS WHICH MAY APPLY TO YOU.

Applicability. These terms and conditions apply between you and Calutech (Company), owner of the Old Chicago Coffee brand name, with respect to your purchases of products (“Products”) from OldChicagoCoffee.com (the “Internet Purchase Page”) or any other website, catalog, marketplace or listing used by our company Calutech, or by using or applying to our dropshipping program, either on the Internet or in print, radio, television or any other form of advertisement. These terms and conditions shall apply and not be altered without our express written permission.

Sales from the Internet Purchase Page are limited to Customers who are at least 18 years of age.

Shipping. Company reserves the right to select alternative carriers for shipments. Shipping charges are invoiced according to costs related to UPS, FedEx or USPS. All liability for loss passes to the customer once it leaves our warehouse, however we will honor replacement merchandise for damaged shipments after the damaged item(s) have been returned to us. Claims of non-delivery to USA addresses will be honored if no proof of delivery is offered by UPS or USPS, otherwise merchandise shall be deemed delivered. International shipments are not guaranteed and not refundable, regardless of package tracking information status, since many international deliveries are not scanned or held by customs. It is the purchaser\’s responsibility to ensure the package can be delivered to their destination before placing the order.

Payment terms. Credit card is the default form of payment that will be accepted for Product orders on the Internet Purchase Page or you can choose alternative methods offered. We will accept orders made by fax or mail-in check or money order. Your check must clear before shipping occurs. All orders received are subject to acceptance by Old Chicago Coffee in our sole discretion. All processed orders are subject to availability. Old Chicago Coffee is not liable for delay in product shipment. Orders submitted to us are secure through Secure Socket Layer encryption (SSL) for security.

Sales Tax. We are required by law to collect all applicable sales tax. Customer authorizes us to add sales tax to any order shipping to Illinois.

Time In Transit Damage Claims. Ownership of each product belongs to you, the Customer, once package is picked-up from our distribution facility by yourself or by any shipping company. Any damage or loss which occurs during transit will be covered by us unless damage or loss occurs when the package is shipped by special carrier selected by the Customer. Our standard shipping company is United States Postal Service with optional UPS which can be selected at checkout where available.

Returns. We do not accept returns for grocery items, all food/coffee sales are final. Other merchandise may be returned for 30 days. Full return and refund information is available in our Refunds and Returns policy.
Defective merchandise will be exchanged or refunded, at our discretion, for same or similar product within 14 days of delivery. No replacements or exchanges after 14 days of delivery per tracking number. Refunds are not given for any claims.

Limitation of Damages & Liability. Old Chicago Coffee is in no way liable to any Customer for any special, incidental, consequential or punitive damages, or for any claim by any third party. Customer agrees that for any liability related to the purchase of any Products. Company is not liable for any amount of damages above the aggregate dollar amount paid by Customer for the purchases under this agreement.

Reservations & Exceptions. We reserve the right to adjust pricing on products without notice. In addition we reserve the right to modify terms, specifications and the like for Products on the Internet Purchase Page or Website at any time without notice. Any errors in Product specifications, descriptions, and pricing are subject to correction by us. We also reserve the right to reject any order that is not consistent with these terms & conditions or our sales policy guidelines including dropshipping services.

User Submitted Content and Property. By using the Site or our own manual dropshipping platform directly operated by us, or the Dripshipper dropship platform offered by a 3rd party, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms of Use; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not access the Site through automated or non-human means, whether through a bot, script or otherwise; (6) you will not use the Site or any of the direct or 3rd party dropshipping services for any illegal or unauthorized purpose including but not limited to trademarks, copyrights, patents or any other intellectual property owned by others; and (7) your use of the Site will not violate any applicable law or regulation. If you provide any information that is untrue, inaccurate, not current, or incomplete, or attempt to use or submit for use any unauthorized content or intellectual property we have the right to, and will, suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).

Offensive, Racial, Hate, Discrimination or Terrorism related Names, Images or Logos or advertising methods. You agree, regardless of how you access our dropshipping, white label or private label services, or via any comments left on our Website, that you will not promote through comments or on your coffee labels, or brand, anything offensive to others, or related to race, religion, human rights, hate, discrimination or terrorism and the like. We reserve the right to decline any shipping or printing of any such materials or products since these items can expose us to legal liability.

Governing Law. Our Website, including the Internet Purchase Page, are operated and administered by offices in the State of Illinois, U.S.A.. This agreement and any sales hereunder shall be governed by the laws of the State of Illinois. Customer and/or dropship clients agree to submit to the jurisdiction and venue of the federal or state courts of the State of Illinois, County of Cook, for any disputes, claims or causes of action involving this Internet site, the Internet Purchase Page, or these terms & conditions. Customer and/or Website visitors agree to abide the laws of the United States and any applicable state laws. No representations are made that this Internet site, the Internet Purchase Page, or any of our Website information or materials, products or contents are appropriate or available for use outside the United States of America.
